USE AND RETURN AGREEMENT
1. Introduction
This Use and Return Agreement is a legal agreement between Pixiora Web Design and Social Media Specialization (hereinafter referred to as "Pixiora", "Company", "We", "Us", "Our" or "Service Provider") and all users (hereinafter referred to as "User" or "You") who purchase services and/or use the website through www.pixiora.com (hereinafter referred to as "Website" or "Site"). By using our website, you agree to all provisions of this agreement.
2. Delivery of Services
Pixiora provides web design, social media management, digital marketing, SEO consulting and other related services. The User may request and purchase such services through the Website. However, Pixiora reserves the right to unilaterally change the details, scope and terms of each of the services offered. Pixiora may change the specifications of the services provided through the Website at any time.
3. Service Procurement and Payment
Users wishing to receive the Service must create an order on the Website and pay by the specified payment methods. Before making the payment, the User must carefully review and accept the prices, content and conditions of the service. Once the payment process is completed, you will receive a confirmation email that your order has been confirmed. Pixiora has the right to start the provision of the service only when the payment is completed.
4. Return and Cancellation Policy
Due to the nature of the services offered, Pixiora does not issue refunds or cancellations after payment has been received. However, except in some special cases, refund requests can only be considered under certain conditions:
- Service Not Started: If the service has not yet started as of the day the order was placed, the user may request the full amount paid. However, the user must request cancellation before the start of the service and this must be done with Pixiora's approval. In this case, Pixiora will evaluate at its sole discretion whether the refund request will be honored or not.
- Partial Provision of Service: If the service was provided in part, the refund request may be considered, but only a proportionate part of the service provided to the user will be refunded. However, the user must contact Pixiora within the specified period for the refund request.
- Return Request Conditions: Requests for refunds, in writing, may be made only info@pixiora.com can be sent to Pixiora's address. The refund request will be considered if it meets the criteria set by Pixiora. Pixiora reserves the right to evaluate each and every request for refund and shall make the final decision in each case.
5. User Responsibilities
The User agrees to use the Website only for legal, ethical and appropriate purposes in accordance with the Website. The User agrees that the intellectual property rights of all content, materials and services on the Website belong to Pixiora and that these contents may not be copied, reproduced or distributed without permission. The User may access the contents, materials and digital products provided through the Website for personal purposes only and may not use such contents for commercial purposes. The User is obliged to comply with all instructions regarding the services provided by Pixiora on the Website.
6. Website Access and Use
Pixiora reserves the right to interrupt, modify, temporarily close or remove the content of the Website at any time. 8. Warranty and Disclaimer
Pixiora is committed to ensuring that the services it offers are of high quality and professionalism. However, it states that the performance of services such as web design, digital marketing or social media services cannot be guaranteed and may not meet users' expectations. Pixiora cannot be held liable for any direct or indirect damages resulting from the failure of any service, errors, interruptions, delays or misunderstandings. Pixiora does not guarantee the accuracy and timeliness of all content provided on the Website.
9. Legal Enforcement and Jurisdiction
This agreement is governed by the laws of the Republic of Turkey. In case of any legal dispute, Istanbul Courts and Enforcement Offices shall be competent. The User, as a party to this agreement, accepts the jurisdiction of Istanbul Courts for the understanding and implementation of the terms of the agreement.
10. Contract Amendments
Pixiora reserves the right to modify this Use and Return Agreement at any time. Changes will be effective from the moment they are published on the Website. Users are obliged to check this page regularly to be aware of any changes. All changes made under this agreement shall take effect without the consent of the users.
